These Terms of Service ("Terms") govern your access to and use of E-Bargaining Global Pvt. Ltd., including any content, functionality, and services offered on or through our website and bargaining platform.
Please read these Terms carefully before using our platform. By creating an account or using our services, you agree to be legally bound by these Terms. If you do not agree, please do not use our services.

1. Agreement to Terms
Acceptance of Terms
By accessing and using E-Bargaining, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
Modifications to Terms
E-Bargaining Global Pvt. Ltd. reserves the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of the platform constitutes acceptance of any modifications.
Age Requirement
You must be at least 18 years old to create an account and use our services. By using our platform, you represent and warrant that you meet this age requirement.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
2. User Conduct & Responsibilities
Prohibited Activities
You may not use our platform for illegal activities, fraud, harassment, spam, or any conduct that violates applicable laws or harms other users or our business.
Accurate Information
You must provide accurate, current, and complete information when creating an account and making purchases. Providing false information may result in account termination.
Bargaining Guidelines
While bargaining is encouraged, all offers must be made in good faith. False offers, price manipulation, or abusive bargaining practices are strictly prohibited.
Intellectual Property
You may not upload, post, or transmit any content that infringes on intellectual property rights, including copyrights, trademarks, or patents of others.
3. Products & Services
Product Listings
Sellers are responsible for accurate product descriptions, images, and pricing. E-Bargaining is not responsible for the accuracy of product information provided by sellers.
Product Availability
All products are subject to availability. We reserve the right to limit quantities and may refuse service to anyone at our discretion.
Price Accuracy
While we strive for accuracy, we are not responsible for typographical errors or incorrect pricing information. We reserve the right to cancel orders placed with incorrect pricing.
Product Quality
We facilitate transactions between buyers and sellers but do not guarantee product quality. All product quality issues should be resolved directly with the seller.
4. Payments & Transactions
Payment Processing
All payments are processed through secure third-party payment processors. We do not store your complete payment information on our servers.
Transaction Security
We implement industry-standard security measures to protect your financial information. However, we cannot guarantee absolute security of internet transmissions.
Refund Policy
Refunds are subject to the seller's individual return policy. E-Bargaining facilitates refund requests but the final decision rests with the seller.
Currency & Pricing
All prices are displayed in Nepalese Rupees (NPR) unless otherwise specified. Prices are subject to change without notice.
5. Legal & Dispute Resolution
Governing Law
These terms are governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law principles.
Dispute Resolution
Any disputes arising from these terms or your use of our platform will be resolved through binding arbitration in Kathmandu, Nepal, in accordance with Nepalese arbitration laws.
Limitation of Liability
E-Bargaining shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our platform.
Indemnification
You agree to indemnify and hold E-Bargaining harmless from any claims, damages, or expenses arising from your violation of these terms or applicable laws.
6. Bargain Price Disclaimer
Finality of Agreed Bargain Price
Prices displayed after bargaining are final and accepted by both buyer and seller. Once an order is confirmed, the agreed bargain price cannot be changed unless both parties mutually agree in writing.
Binding Agreement
By completing a bargain session and confirming an order, both the buyer and the seller enter into a binding price agreement. Neither party may unilaterally revise the confirmed price after the order has been placed.
Dispute Prevention
This clause exists to protect both buyers and sellers from post-confirmation price disputes. Any attempt to alter an agreed price after order confirmation without mutual consent may result in account suspension.
Price Expiry
Agreed bargain prices are time-sensitive and held for a limited window (typically 15 minutes) after acceptance. Failure to complete checkout within this window will cause the bargain price to expire and require re-negotiation.
7. Seller Responsibilities & Photo Evidence
Photo Evidence Requirement
All sellers must upload photographic evidence before marking an order as shipped. This includes: (1) product photos taken before packaging, (2) sealed packaging photos, and (3) courier receipt or tracking number documentation. Failure to provide evidence may result in dispute resolution being ruled against the seller.
Accurate Listings
Sellers must ensure all product listings accurately represent the item being sold, including correct images, descriptions, specifications, and condition. Misleading listings, counterfeit products, or fraudulent activities will result in immediate account suspension or permanent removal from the platform.
Shipping Timeline
Sellers are required to prepare and dispatch orders within 24–48 hours of order confirmation to maintain their seller rating. Consistent delays without valid reason may result in account penalties.
Dispute Evidence
Sellers may be required to provide evidence — including shipping photos and courier receipts — during dispute investigations. E Bargaining reserves the right to rule in favour of buyers if adequate seller evidence is not provided.
8. Buyer Protection Policy
Platform Guarantee
If your product never arrives, arrives damaged, or is significantly different from the listing — E Bargaining will investigate and take appropriate action, including refund processing where applicable.
Dispute Reporting
Buyers must report any disputes through the E Bargaining platform within the specified dispute period after the order's expected delivery date. Disputes reported outside this window may not be eligible for platform-level resolution.
Safe Payments
All payments are processed securely through approved payment channels (FonePay, Wallet, COD). Your financial information is never shared with sellers. E Bargaining does not store full card or banking details on its servers.
Fraudulent Claims
E Bargaining reserves the right to investigate fraudulent return claims or policy violations. Buyers found to have submitted false claims, switched products, or engaged in delivery fraud may have their accounts suspended.
9. Platform Policies
Account Suspension
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activities, or misuse our platform. This applies to both buyers and sellers.
Content Removal
We may remove or disable access to content that violates these terms, applicable laws, or our community guidelines without prior notice.
Service Availability
We do not guarantee uninterrupted access to our platform. Services may be temporarily unavailable for maintenance, updates, or technical issues.
Third-Party Links
Our platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of service of external sites.
